In a landmark historic occasion today 11 June 2008 at the court of appeal criminal division the legal argument that modchips do not circumvent copyright protection was upheld by Judge Justice Jacobs.

The granting of this appeal based on the argument that the copyright infringement has already taken place before the use of a modchip has resulted in the squashing of all 26 counts against MrModchips (http://www.mrmodchips.co.uk/catalog)

The defendant MrModchips (http://www.mrmodchips.co.uk/catalog) was awarded full costs as a result of his successful appeal and offered his most sincerest thanks to his legal team and his many well wishers who had supported his fight for justice in the face of what are now no more than corporate public bullies.

The normally very vocal Michael Rawlinson from ELSPA was strangly unavaliable for comment today.

Mr Rawlinson was originally quoted as saying

What it does now is mark a milestone in the fight against overzealous independant agencies who have their strings pulled by corporations as opposed to the genuine concerns of the electorate.

What will these mean for modchips in the UK ?????? Truly a disastor for the likes of ELSPA and Trading Standards.

yay now only if they would allow them to be sold in the us it would be nice it sucks you have to send over seas just for a little chip that costs 10 dollers to make and we end up paying 50+

Video game companies don't loose as much money, in my opinion, from modchips as they do for used video game stores. I know many will say yeah right, but think about it. How many people do you think have modded systems compared to people who buy used games at video game stores or pawn shops. Many people don't feel spending $100-$600, depending on if you have a system you own modded or just buy one modded, when they spend $25-$50 for a used game. You also need to figure in that, just guessing here, around 2-5 % of games that are at a used store are stolen and were never bought. Every company that sells electronics, like best buy or circuit city for example, have insurance to cover loss merchandise that is stolen every year so part of that money is recovered for the company. Also consider how many of the used copies that are sold at the game store have been both bought and sold used more than once. This is all just my opinion about the subject, but I can see how modchips don't hurt video game publishers and developers as much as the ability to legally sell used games does.
